Notons toutefois que la jurisprudence retient deux crit\u00e8res essentiels :\u00a0<b>l&rsquo;importance de la r\u00e9paration et le caract\u00e8re exceptionnel de la d\u00e9pense.<\/b><\/p><p>A titre d&rsquo;exemple sont consid\u00e9r\u00e9s comme des grosses r\u00e9parations :<\/p><p>&#8211; la r\u00e9fection totale de la toiture<\/p><p>&#8211; la r\u00e9fection des zingueries affectant une partie importante de l&rsquo;immeuble<\/p><p>&#8211; la r\u00e9fection totale d&rsquo;un syst\u00e8me de climatisation d&rsquo;un immeuble afin qu&rsquo;il soit conforme \u00e0 sa destination<\/p><p>&#8211; le ravalement d&rsquo;un immeuble si il concourt \u00e0 son \u00e9tanch\u00e9it\u00e9.<\/p><p><b>En l&rsquo;absence de liste pr\u00e9cise et limitative, c&rsquo;est au tribunaux qu&rsquo;il revient d&rsquo;appr\u00e9cier au cas pas cas ce qui rel\u00e8ve ou non de l&rsquo;article 606.\u00a0<\/b><\/p><p>Il\u00a0 est donc important d&rsquo;aborder le sujet de la r<b>\u00e9partition des travaux<\/b>\u00a0lors de la n\u00e9gociation d&rsquo;un bail commercial , afin d&rsquo;\u00e9viter tout conflit ult\u00e9rieur.<\/p><p>L&rsquo;inventaire pr\u00e9cis des cat\u00e9gories de charges (&#8230;) pr\u00e9vu par l&rsquo;article L 145-40-2 du code de commerce que le bailleur doit \u00e9tablir lors de la signature d&rsquo;un bail commercial et qui comporte l&rsquo;indication de la r\u00e9partition\u00a0 entre le bailleur et le preneur , permettra de pr\u00e9ciser et de discuter des engagements et de la responsabilit\u00e9 des parties.<\/p><p>Octobre 2022.<\/p><p>Image : source Pixabay\u00a0<\/p><\/div>\n        \t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>L&rsquo;article 606 du code civil qui est d&rsquo;ordre public, impute\u00a0obligatoirement au bailleur la charge des grosses r\u00e9parations : &#8211; r\u00e9parations des gros de murs et vo\u00fbtes &#8211; r\u00e9tablissement des poutres et des couvertures enti\u00e8res &#8211; r\u00e9tablissement des digues et des murs de sout\u00e8nement et de cl\u00f4ture en entier.
