Le d\u00e9cret\u00a0 n\u00b0 2019-771 du 23 juillet 2019 dit\u00a0<b>D\u00e9cret Tertiaire\u00a0<\/b>vient fixer les conditions d&rsquo;application de cette mesure.\u00a0<\/p><p>La premi\u00e8re \u00e9ch\u00e9ance pour les assujettis est imminente puisque les professionnels doivent enregistrer l&rsquo;ensemble des b\u00e2timents et transmettre leurs bilans \u00e9nerg\u00e9tiques dans la base de donn\u00e9es num\u00e9rique baptis\u00e9e\u00a0 OPERAT\u00a0<b>avant le 30 septembre 2022.\u00a0<\/b><\/p><p>Le d\u00e9cret s&rsquo;inscrit dans la lutte contre le r\u00e9chauffement climatique et vise la\u00a0<b>r\u00e9duction significative de l&#8217;emprunte carbone des b\u00e2timents tertiaires.<\/b><\/p><p>Des objectifs pr\u00e9cis de r\u00e9duction des consommations ont \u00e9t\u00e9 fix\u00e9s par d\u00e9cennie :<\/p><p>&#8211; 40% en 2030 par rapport \u00e0 l&rsquo;ann\u00e9e de r\u00e9f\u00e9rence d\u00e9clar\u00e9e.<\/p><p>&#8211; 50% en 2040 par rapport \u00e0 l&rsquo;ann\u00e9e de r\u00e9f\u00e9rence d\u00e9clar\u00e9e.<\/p><p>&#8211; 60% en 2050 par rapport \u00e0 l&rsquo;ann\u00e9e de r\u00e9f\u00e9rence d\u00e9clar\u00e9e.<\/p><p><b>Le d\u00e9cret\u00a0 s&rsquo;applique aux b\u00e2timents neufs et anciens \u00e0 usage tertiaire:<\/b><\/p><p><b>&#8211;<\/b>\u00a0Il concerne les locaux administratifs ou d&rsquo;enseignements, l<b>es bureaux, commerces , les entrep\u00f4ts logistiques, les locaux d&rsquo;activit\u00e9s<\/b>, les \u00e9tablissements de sant\u00e9 \u2026<\/p><p>&#8211; Les b\u00e2timents doivent atteindre une surface minimale de plus de 1 000 m\u00b2.<\/p><p>&#8211; Les objectifs et obligations fix\u00e9es concernent \u00e0 la fois les bailleurs et les locataires.
